Bargaining Rules and Guidelines—Sample

Following is a hypothetical agreement about the rules and guidelines for bargaining that the chief spokespersons would have negotiated. The idea is to review it with the negotiations participants in the opening joint session before any proposal is handed across the table. The intent is to ensure that all participants, not just the chief spokespersons, are on the same page regarding process and behavior expectations. This gives you documentation to remind your counterpart of the expectations that the parties agreed to in advance. And it is evidence for any outside party (attorney, mediator, arbitrator, or judge, for example) of the parties’ intent going into bargaining.
